Welcome to PsychicWorld.com (the "Site" or "Platform"), including our mobile applications on Android and iOS (collectively, the "Apps"). These Terms and Conditions ("Terms") govern your access to and use of the Platform and Apps, operated by Consulto B.V., a company registered in the Netherlands (the "Company," "we," "us," or "our"), located at Oderweg 1 #8547, 1043 AG Amsterdam, Netherlands. The Company operates PsychicWorld as a global online platform connecting users ("Clients" or "you") with independent psychics ("Psychics") for entertainment purposes only, such as live chat readings, tarot, horoscopes, and spiritual guidance.

Important Notice: Entertainment Purposes Only. All services, readings, advice, predictions, or information provided through the Platform or Apps are for entertainment and amusement only. They are not intended as, and should not be relied upon as, professional, medical, legal, financial, psychological, or therapeutic advice. PsychicWorld does not endorse, verify, or guarantee the accuracy, validity, or outcomes of any Psychic's services. By using the Platform or Apps, you acknowledge that decisions based on readings are your sole responsibility, and you release us from any liability for actions taken or not taken as a result.

Our primary focus is on users in the United States, but the Platform and Apps are available globally. If you are a resident of the European Union (EU), these Terms comply with the General Data Protection Regulation (GDPR) and Dutch consumer laws. For California residents (under the California Consumer Privacy Act, or CCPA), we provide additional rights regarding your personal information (e.g., right to know, delete, or opt-out of sales/sharing—see our Privacy Policy). Non-EU/US users should review local laws, as these Terms are governed by Dutch law (see Section 19).

By accessing or using the Platform or Apps, you agree to these Terms, our Privacy Policy (incorporated by reference), and any additional guidelines. If you do not agree, do not use the Platform or Apps. You must be at least 18 years old (or the age of majority in your jurisdiction) to use our services. EU users aged 16-17 may use the Platform or Apps with parental consent where required by local law.

1. Limited License

We grant you a limited, non-exclusive, revocable license to access and use the Platform and Apps for personal, non-commercial purposes, subject to these Terms. You may not: (a) copy, modify, distribute, or create derivative works from the Platform or Apps; (b) reverse engineer or attempt to access non-public areas; (c) use bots, scripts, or automated tools to scrape or interfere with the Platform or Apps; or (d) violate any applicable laws. We reserve all rights not expressly granted.

2. User Accounts and Responsibilities

To use certain features (e.g., bookings, chats), you must create an account with accurate information (e.g., name, email). You are responsible for maintaining confidentiality of your login credentials and all activity under your account. Notify us immediately at support@psychicworld.com of any unauthorized use. By registering or checking out (on the Platform or Apps), you confirm you have read, understood, and agree to these Terms and our Privacy Policy. We may suspend or terminate accounts for violations, abuse, or at our discretion.

3. Platform Services and Rules of Conduct

The Platform and Apps facilitate connections between Clients and Psychics for entertainment services (e.g., live chats, readings). We do not provide services directly—we are a neutral marketplace. You agree to:

  • Use the Platform and Apps only for lawful purposes.
  • Not post harmful, abusive, or illegal content (e.g., harassment, spam, threats).
  • Respect Psychics: All interactions must occur via the Platform or Apps—no off-platform contact.
  • Report violations to us promptly.

We may moderate content, remove violations, or report illegal activity to authorities (per EU Digital Services Act requirements). Prohibited: Multiple accounts for abuse (e.g., free bonuses), fraud, or impersonation.

4. Psychic Interactions

  • For Clients: You may browse and book Psychics. Transactions are direct between you and the Psychic, processed via the Platform or Apps. You are responsible for all bookings under your account. Future interactions outside the Platform or Apps (e.g., direct payments) are your risk—we are not involved.
  • For Psychics: If you are a Psychic, you must apply and be approved. You agree to provide services ethically, for entertainment only, and comply with these Terms. You are an independent contractor—we do not employ you. Set your rates/tariffs via the Platform or Apps; all payments flow through us (see Section 6).
  • Licensed Professionals: If a Psychic claims qualifications (e.g., therapist), verify independently—we do not warrant credentials. Readings are entertainment, not substitutes for licensed advice.
  • Age and Consent: Users under 18 prohibited. EU minors (13-15) need parental consent for data processing (per GDPR).

5. Mobile Applications

PsychicWorld offers mobile applications on the Apple App Store (iOS) and Google Play Store (Android). These Terms fully apply to your use of the Apps, including all features (e.g., live chats, bookings, in-app purchases). The Apps comply with the rules and regulations of the respective app stores, including:

  • Apple App Store: Adherence to Apple’s App Store Review Guidelines, including in-app purchase rules (via Stripe, Mollie, or PayPal) and content policies (e.g., no objectionable material).
  • Google Play Store: Compliance with Google Play’s Developer Program Policies, including payment processing and user safety standards.

When using the Apps, you agree to:

  • Follow these Terms and any app-specific guidelines provided during download or use.
  • Use in-app purchases only through our designated PSPs (Stripe, Mollie, PayPal—see Section 6).
  • Not bypass app store payment systems or engage in prohibited activities (e.g., sideloading, jailbreaking).
  • Acknowledge that app-specific data collection (e.g., device info, push notifications) is governed by our Privacy Policy.

We may update or discontinue the Apps at any time, subject to app store policies. For issues (e.g., crashes), contact support@psychicworld.com. App store providers (Apple, Google) are not parties to these Terms and are not responsible for our services.

6. Payments, Fees, and Refunds

All transactions (on the Platform or Apps) use secure payment service providers: Stripe, Mollie, and PayPal. We do not store full payment details—processing complies with PCI-DSS standards (encrypted servers, firewalls). Payments are in USD/EUR; fees may apply (e.g., currency conversion).

  • Client Fees: Pay per minute/session as set by the Psychic. New users may get promotional credits (e.g., free minutes)—one per account/IP.
  • Psychic Tariffs: Psychics set rates; we deduct a commission (disclosed during signup).
  • Strict Refund Policy: Due to the digital, entertainment nature of services, no refunds or credits for completed sessions/readings (once started). This protects Psychics and ensures fair compensation. Exceptions (at our sole discretion):
    • Technical failure preventing session start (e.g., Platform or App outage)—refund within 48 hours if reported immediately.
    • Duplicate charges—full refund within 7 days.

To request (limited cases only): Email refund@psychicworld.com with order ID, timestamp, and evidence. Response in 3-5 business days. Refunds issued to original payment method; processing fees non-refundable. No refunds for dissatisfaction, change of mind, or "unhelpful" readings—entertainment value is subjective.

  • Chargebacks: We maintain a strict no-chargeback policy. Chargebacks (e.g., via Stripe Ltd., Mollie, or PayPal International) harm our Platform, Apps, and Psychics. By registering and completing checkout (on the Platform or Apps), you validate these Terms, including this policy. If you initiate a chargeback:
    • We will defend vigorously, sharing all relevant data (e.g., your terms acceptance proof, chat logs, IP address, transaction details, session recordings) with PSPs.
    • Unauthorized chargebacks may result in account suspension, denial of future services, recovery of fees/costs from you, or legal action (including small claims in Amsterdam or your jurisdiction).
    • Report disputes to us first—we resolve 95% without escalation.

Direct billing by Psychics (bypassing Platform or Apps) voids protections—report to us immediately. For US users (CCPA): No "sales" of personal data, but opt-out rights apply to sharing (see Privacy Policy).

7. Intellectual Property

The Platform, Apps, and content (e.g., text, logos, software) are owned by us or licensors—protected by copyright, trademark, and other laws. You get no ownership rights. User content (e.g., reviews) grants us a non-exclusive, worldwide, royalty-free license to use, display, and modify for Platform/App operations. Do not infringe third-party rights.

8. Third-Party Services and Links

We use third parties (e.g., Stripe, Mollie, PayPal for payments; Google/Facebook for logins—see Privacy Policy). Their policies apply once you interact with them. The Platform or Apps may link to external sites—we are not responsible for their content, privacy, or practices. Use at your own risk.

9. Disclaimer of Warranties

FOR ENTERTAINMENT ONLY. The Platform, Apps, and services are provided "AS IS" and "AS AVAILABLE," without warranties (express/implied). We disclaim warranties of merchantability, fitness for purpose, or non-infringement. Readings may be inaccurate or unhelpful—no guarantees. We do not verify Psychics or outcomes. Availability may vary; we are not liable for interruptions. For US users: Some states limit disclaimer scope—check local laws.

10. Limitation of Liability

To the fullest extent permitted by law, our total liability (including affiliates, Psychics) is limited to the amount you paid us in the 12 months prior (max €100 if no payment). We are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages (e.g., lost profits, emotional distress). This applies even if advised of risks. For EU users (GDPR/consumer laws): Liability for gross negligence/willful misconduct not excluded. US (CCPA): No liability for data breaches if reasonable security used.

11. Indemnification

You agree to indemnify and hold us harmless from claims, losses, or expenses (including attorneys' fees) arising from your use, violations of Terms, or infringement. We will notify you of claims and cooperate.

12. Termination

We may suspend/terminate access to the Platform or Apps anytime for violations, without notice or liability. Upon termination, obligations (e.g., payments) survive. You may stop using the Platform or Apps anytime.

13. Dispute Resolution

Governing Law: These Terms are governed by Dutch law, without conflict principles. EU disputes: Subject to your local consumer protections. US disputes: Binding arbitration in Amsterdam (via ICC rules) for claims under $10,000; class actions waived. For CCPA: California courts for privacy claims. Contact us first for informal resolution (30 days).

14. Changes to Terms

We may update Terms (e.g., for legal changes)—posted here with "Last Updated" date. Continued use of the Platform or Apps = acceptance. Material changes (e.g., payments) emailed to registered users.

15. Miscellaneous

No assignment without our consent. If a provision is invalid, others remain. No waiver unless written. Force majeure (e.g., outages) excuses delays. Entire agreement—supersedes priors.
